A U.S. person is generally required to file an annual Form 1040 every year when their gross income exceeds the standard deduction. A U.S. person includes a U.S. citizen, a U.S. green card holder, or other person that meets the substantial presence test during the year.

Income Tax Compliance & Reporting for Non-U.S. Persons (Form 1040-NR)

A non-U.S. person is generally not required to file an income tax return with the IRS.
